Contractual document that states the contracting of products and services throughout the website www.cafesvitoria.com
As user or client specifically declares to know, understand and accept the conditions of use and the general terms and conditions of purchase. Moreover, it declares to be of legal age, to have the legal capacity to access the websites of CAFES VITORIA S.L. and contracting through them.
The current conditions will have an indefinite validity period and will be applicable to any purchases carried out through the site www.cafesvitoria.com
CAFES VITORIA S.L. reserves the right to modify the General Terms and Conditions, without prior notice and as it deems appropriate. These modifications can be made, through their websites, by any admissible form in law and shall be binding during the time they are published on the web and until they are validly modified by subsequent ones. However, CAFES VITORIA S.L. reserves the right to apply, in certain cases, a Particular Contract Conditions in preference to the current General Conditions when it deems appropriate, announcing them in a timely and appropriate manner.
The duration of the contract will be linked to the delivery of the product without prejudice to the right of withdrawal.

After the purchase, the customer will receive a confirmation by email. It is essential that during the purchase process the user indicates a valid e-mail address. Offer and validity
In the event of a product offer, the discounted price and its validity will always be indicated along with its essential characteristics.
In compliance with current regulations CAFES VITORIA S.L. offers information on all items for sale, their characteristics and prices. However, CAFES VITORIA S.L. reserves the right to withdraw, replace or change the products offered through its website, by simply changing the content of it. In this way, the products offered at any time by the website will be stated in the General Contracting Conditions. Moreover, the company will have the right to stop the offering of those products, without prior notice and at any time.
All products are offered in Euros and include the current Value Added Tax (VAT).
If any other tax were applicable, this would be indicated (IGIC or IPSI).
Delivery and transportation costs
CAFES VITORIA S.L. provides shipment throughout the Spanish Peninsula territory and the Balearic Islands. Shipments are free for orders over € 49.99.
For orders with an amount lower than € 49.99, the user will be able to check the total amount to be paid (including shipping costs) once the shipping data is introduced. Being able to modify in any case, the content of the order before it is processed.
CAFES VITORIA SL will deliver the order within an approximate period of 48 hours, if the order has been placed before 1 pm. For orders after 1 pm, these will be prepared the following day, with an actual delivery time within 72 hours upon acceptance of the payment.
Payment and orders.
Orders can be paid with the following credit cards: VISA, Mastercard or Maestro credit card.
All transactions involving any personal or banking data are made through a secure environment, a server based on the standard security technology SSL (Secure Sockets Layer). All information provided to us is encrypted throughout the network.
Likewise, the data on your credit card is processed directly through the bank website, in the POS (Point of Sale Terminal of the Bank) and are not entered or registered in any server of CAFES VITORIA S.L.
When paying with VISA, MASTERCARD or MAESTRO cards, you will always be asked for the following information: card number, the expiration date, and a Validation Code that matches the last three digits of the number printed in italics on the back of your card. Offering this way, more guarantees about the security of the transaction.
This form of payment is valid online.
In the event of a fraudulent or improper use of the credit card, its holder may request the immediate cancellation of the charge. In this case, the corresponding debit and credit entries in the accounts of the provider and the owner will be made as soon as possible.
However, if the purchase had actually been made by the cardholder and the refund requirement was not a consequence of having exercised the right of withdrawal, and therefore, had unduly demanded the cancellation of the corresponding charge, that amount will remain liable against CAFES VITORIA S.L. in order to compensate the damages and losses caused as a result of said cancellation.
The availability of the products offered by CAFES VITORIA S.L. may vary depending on the actual demand. Although CAFES VITORIA S.L. updates the stock regularly, the requested product could be sold out at that moment. In the event of unavailability, CAFES VITORIA S.L. will notify the customer as soon as they have knowledge of this situation, by means of an e-mail or by telephone. The period of this communication will not exceed in any case 30 days. CAFES VITORIA S.L. may offer two options: supplying the customer a product of similar characteristics or of superior quality without a price increase. Or, unless justified and demonstrable by CAFES VITORIA S.L. within this same period, to return the due amount.
Right of withdrawal, returns and complaints
Right of withdrawal
The buyer will have a period of fourteen calendar days to desist, upon receiving the product, without any penalty and without indication of the reasons.

As established in article 103 of Law 3/2014, of March 27th, which modifies the revised text of the General Law for the defence of Consumers and Users, the supplies of customised services or goods or clearly personalized, or because of their nature, cannot be returned or may deteriorate or expire quickly, are exempt from withdrawal.
The client is obliged to contact CAFES VITORIA S.L., either by phone at +34 933463858 or by e-mail at firstname.lastname@example.org to inform about the reason for the return. CAFES VITORIA S.L., may accept or reject after evaluating the reason of return. In case of acceptance by CAFES VITORIA S.L., a post office label will be sent to the customer so that he can deposit the package at the nearest post office. This shall be done within a maximum of fourteen calendar days from the date on which the right to cancel of the contract is formalized. It will be fulfilled if the client returns the product before the end of the term.
The customer will be responsible for covering the return costs, that that will be deducted from the total amount of the order. The cost of return will be € 4.99 including taxes.
In any case, the returned products must be in perfect condition, unused and in their original packaging. Therefore, it is requested that in order to avoid transport problems, it should be ensured that the package is properly protected and sealed. Upon reception, product conditions will be checked. After checking the article (s), as well as the possible components, accessories, promotional gifts and documentation, are complete and in perfect condition, we will reimburse the paid amount.
The reimbursement will be made using the same means of payment used by the client, unless agreed otherwise. In case of withdrawal, the amount of € 4.99 will be deducted as return costs.
CAFES VITORIA S.L. may withhold the reimbursement until the product has been received, the reason for withdrawal, or until the customer provides proof of return, depending on which condition is met first.
Return of faulty products
In the event that the product is not in good condition and the causes attributable to it, are not a consequence of the customer, it will be entitled to return the product. It is obliged to inform CAFES VITORIA S.L in regards the reason for return through any of the means provided, and at no cost to the client. The return due to faulty or poor condition of the product will not be considered a right of withdrawal.
CAFES VITORIA S.L. will cover the cost of the return and to replace it with a new one in accordance with conditions accepted at the time of sale.

The relationship between the user and the provider will be governed by the regulations in force and applicable in the Spanish territory. If any dispute arises, the parties may submit their disputes to arbitration or go to the ordinary jurisdiction, complying with the rules on jurisdiction and competence in this regard.
